A federal court ruled against the Nuclear Regulatory Commission on used-fuel management last month, saying that it failed to fully perform its duty when it allowed nuclear operators to extend their onsite used-fuel storage up to 60 years. The nuclear industry sees the ruling as a setback and maintains that a permanent storage facility is necessary. The Nuclear Energy Institute is "disappointed by the court's decision," said NEI General Counsel Ellen Ginsberg.
